Job Title: In-House Legal Counsel

Location: San Diego, California (In-office role, candidates must be within a commutable distance or willing to relocate)

About the Role:

We are seeking an experienced attorney to lead our in-house legal team, specializing in real estate contracts and the defense of claims against assisted living and memory care facilities. This high-impact role requires a deep understanding of litigation involving elder abuse, neglect, and medical malpractice. You will also be the legal backbone of our real estate division, overseeing litigation strategies, managing external counsel, and ensuring compliance with industry regulations.

This position offers a unique combination of complex legal work and direct impact, allowing the right candidate to take ownership of critical cases while contributing to the overall success of the company.

Key Responsibilities:

Legal Counsel:

  • Provide expert advice to senior management on complex legal matters, including real estate contracts and litigation strategy and resolution.
  • Serve as a trusted advisor to business leaders, offering guidance on legal implications of operational decisions.

Litigation Management:

  • Lead and manage the defense of claims against assisted living and memory care facilities, focusing on cases involving elder abuse, neglect, and malpractice.
  • Develop and implement litigation strategies that minimize risk and align with the company’s business goals.
  • Manage external counsel and collaborate closely with them to oversee case progress and outcomes.
  • Represent the company in mediations, arbitrations, and court proceedings as needed.

Regulatory Compliance & Risk Mitigation:

  • Ensure compliance with all applicable healthcare and real estate regulations at federal, state, and local levels.
  • Develop strategies to proactively identify and mitigate potential litigation risks.

Collaboration & Reporting:

  • Lead and mentor the in-house legal team and coordinate with outside counsel.
  • Work closely with internal stakeholders across departments, including property management, compliance, and finance.
  • Report directly to the President and Chairman, providing regular updates on active litigation, trends, and potential risks.

Candidate Profile:

Education: J.D. from an accredited law school. Active member of the California Bar in good standing.

Experience:

  • 5-10 years of experience in real estate contracts.
  • 5–10 years of litigation experience, with a strong focus on defending claims involving assisted living, memory care, elder abuse, neglect, or medical malpractice.
  • Proven track record of managing complex litigation and obtaining favorable outcomes.
  • Experience working with or for healthcare providers, insurance companies, or related industries is highly desirable.
